§ 1. General provisions
These Terms and Conditions set out the rules for using the viralcars.pl website (the Website) and for ordering the services offered through it.
The service provider is iD - Mateusz Ozimkowski, Plac Kolanowszczyzna 15/51, 87-800 Włocławek, Poland, tax ID (NIP) 8883171482, REGON 540183264, operating under the ViralCars brand (the Provider). Contact: e-mail kontakt@viralcars.pl, phone +48 880 743 673.
A Customer is an individual, legal entity or organisational unit using the Website or ordering services. A Consumer is an individual performing a legal act not directly related to their business or professional activity. Consumer protection rules apply accordingly to an individual who concludes a contract directly related to their business activity where, from the content of the contract, it is not of a professional nature for them.
These Terms are made available free of charge on the Website in a way that allows them to be obtained, reproduced and stored.
§ 2. Definitions
- Service: promotion of a car listing on social media, including preparing a video and publishing it according to the chosen Package.
- Package: a variant of the Service (Basic, Premium, Turbo) described on the Website with its price, scope, target reach and delivery time.
- Listing: the vehicle advertisement published by the Customer on a classifieds site (for example Otomoto, OLX), whose address the Customer gives in the order.
- Promotional material: a video, reel or other content prepared as part of the Service.
- Order form: the order window available on the Website.
§ 3. Technical requirements and electronic services
To use the Website you need a device with internet access, an up-to-date browser with JavaScript enabled and an e-mail address.
The Provider supplies free electronic services: making the Website content and the Order form available. The agreement for these services is concluded when you start using the Website and lasts until you stop.
It is prohibited to provide unlawful content, to give data of third parties without their authorisation, or to take actions that disrupt the Website.
§ 4. Scope of the Service and Packages
The current description, scope and prices of the Packages are in the pricing section of the Website. On the effective date of these Terms the following are offered:
- Basic: 1 platform (TikTok or Instagram), target reach 5,000 views, basic editing, delivery in 48 hours.
- Premium: 2 platforms (TikTok and Instagram), target reach 15,000 views, editing with effects, delivery in 24 hours, bonus: Instagram Story.
- Turbo: 3 platforms (TikTok, Instagram and Facebook), target reach 30,000 views, premium editing with music, delivery in 12 hours, bonus: Instagram Story and Reel plus a Facebook ad boost.
Prices are given in Polish zloty (PLN) and are the amounts the Customer pays for the Service. The Customer is informed of the price before placing the order. The price applicable to an order is the price shown at the time it is placed.
The reach stated for a Package is the target reach of the campaign. The Provider does not guarantee the sale of the vehicle, the number of enquiries or the sale price, because they depend on factors beyond the Provider’s control, such as the price, condition and description of the vehicle, the quality of the listing and demand.
§ 5. Placing an order and payment
To order a Service the Customer chooses a Package, fills in the Order form (full name, phone, e-mail, link to the Listing, an optional note and invoice details), accepts these Terms and the Privacy Policy, gives the statement described in § 8 paragraph 5 and clicks the button with the obligation to pay.
Payment is made online through the Stripe payment operator. The available payment methods are shown in the Stripe gateway. The Provider has no access to full payment card data.
The agreement for the Service is concluded when the order with the obligation to pay is placed and paid. The Customer receives the payment confirmation from the payment operator at the e-mail address provided.
At the Customer’s request, made in the Order form or by e-mail, the Provider issues an invoice.
§ 6. Performance of the Service
The delivery time stated for a Package runs from the booking of the payment and receipt of complete data, including a valid link to the Listing.
The Provider may ask the Customer to supplement data or materials. The time may be extended accordingly if the delay results from causes on the Customer’s side or beyond the Provider’s control (for example a platform outage or rejection of content by a platform). The Provider informs the Customer of such a situation.
If performing the Service in whole or in part proves impossible for reasons beyond the Customer’s control, the Provider refunds the price in full or in the relevant part, depending on the scope of the unperformed service.
§ 7. Customer’s obligations and rights to materials
The Customer undertakes to provide true data and a link only to the advertisement of a vehicle the Customer is entitled to dispose of.
The Customer declares that they hold the rights to the photos and content in the Listing or are entitled to use them, and grants the Provider a free, non-exclusive licence to use them to prepare and publish the Promotional material as part of the Service.
The Promotional material is published on the Provider’s social media profiles and, for the Turbo Package, in paid promotion on Facebook. The Customer’s contact details are not published unless they appear in the Listing.
The Provider may show the finished Promotional material as an example of its work. The Customer may object to this at any time by writing to the Provider’s e-mail address. At the Customer’s request the Promotional material is removed from the Provider’s profiles within a reasonable time after the campaign ends.
§ 8. Right of withdrawal (Consumers)
A Consumer may withdraw from a distance contract without giving a reason within 14 days of concluding it.
To withdraw, the Consumer sends a statement to kontakt@viralcars.pl or by post to the Provider’s address. The Consumer may use the withdrawal form template attached to these Terms, but it is not mandatory. It is enough to send the statement before the deadline expires.
After withdrawal the Provider refunds payments within 14 days of receiving the statement, using the same payment method, unless the Consumer agrees to another.
If the Consumer requested that the Service begin before the withdrawal period expired and then withdrew, the Consumer must pay for what was performed up to the moment of withdrawal. The amount is calculated in proportion to the scope of the performed service.
When placing the order, the Consumer in a separate statement requests that performance of the Service begin before the withdrawal period expires and acknowledges that after the Service is fully performed they lose the right of withdrawal. After full performance of the Service the right of withdrawal no longer applies.
§ 9. Complaints
The Customer may submit a complaint about non-performance or improper performance of the Service or the operation of the Website to kontakt@viralcars.pl or by post to the Provider’s address.
A complaint should include the Customer’s details, a description of the objections, the expected way of resolving the matter, and the date and number of the order or the e-mail address used for the order.
The Provider handles the complaint within 14 days of receiving it and informs the Customer of the outcome on a durable medium. For a Consumer, failing to respond within that time means the complaint is accepted.
§ 10. Out-of-court dispute resolution
A Consumer may use out-of-court ways of handling complaints and pursuing claims, in particular ask for help from the county (city) consumer ombudsman, apply to the permanent consumer arbitration court at the Voivodeship Trade Inspectorate, or use other forms described on the website of the Office of Competition and Consumer Protection (uokik.gov.pl). Using them is voluntary.
§ 11. Liability
The Provider is not liable for: the content and accuracy of the Customer’s Listings, the decisions and operation of social platforms and classifieds sites, interruptions of the internet or the Website due to causes beyond the Provider’s control, or the results of selling the vehicle.
Towards Customers who are businesses without consumer rights, the Provider’s liability is limited to the price paid for the given Package, excluding damage caused intentionally.
This section does not limit the rights Consumers have under mandatory provisions of law.
§ 12. Personal data
The rules for processing personal data are described in the Privacy Policy and the Personal data information notice.
§ 13. Intellectual property of the Website
The content of the Website (texts, graphics, logo, layout, code) is protected by law. Copying, distributing or using it without the Provider’s consent is prohibited, except for permitted use.
§ 14. Final provisions
Polish law applies to agreements concluded under these Terms. Disputes with Customers who are businesses are decided by the court competent for the Provider’s registered office. Disputes with Consumers are decided by the court competent under the general rules.
The Provider may amend these Terms for important reasons, in particular a change in law or in the scope of services. Orders placed before the change are performed under the rules in force on the day they were placed.
The Website is available in Polish, English and Russian. Foreign-language versions are for convenience, and in case of discrepancy the Polish version prevails.
These Terms take effect on the date shown on this page.
